(Delivering the Lead Ruling)The Appellant, as applicant, filed a motion on notice dated the 6th of February, 2017 on the same day before the Honorable Court. The motion prays for:i. An order of this Honorable Court enlarging the time within which the Appellant may seek leave to appeal against the rulings of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 19th of June, 1998 and 18th day of March, 2002 respectively. ii. An order of this Honorable Court granting the Appellant leave to appeal against the rulings of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 19th of June, 1998 and 18th day of March, 2002 respectively. iii. An order of this Honorable Court enlarging the time within which the Appellant may appeal against the rulings of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 19th of June, 1998 and 18th day of March, 2002 respectively. iv. An order of this Honorable Court granting the Appellant leave to amend his notice of appeal dated and filed on the 16th of1February, 2005 against the decision of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 16 of February, 2005. v. An order of this Honorable Court granting the Appellant leave to incorporate the grounds of appeal against the rulings of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 19th of June, 1998 and 18th day of March, 2002 respectively in the proposed amended notice of appeal against the final decision of the High Court of Plateau State sitting in Jos delivered in Suit No PLD/J66/97 on the 16 of February, 2005. vi. An order of this Honorable Court deeming the Appellant’s Amended Notice and Grounds of Appeal as duly filed and served. vii. An order of this Honorable Court granting the Appellant enlargement of time within which to file and serve the Appellant’s brief of argument. The grounds of the application were stated on the face of the motion paper and the application was supported by an affidavit of thirteen paragraphs deposed to on the 16th of February, 2017, with exhibits attached, as well as by a further affidavit of twelve paragraphs deposed to on the213th of March, 2017. The Respondents opposed the application and they filed a counter affidavit of nine paragraphs with some subparagraphs and it was deposed to on the 16th of February, 2017, with exhibits attached.
